Terms of sale and use

1. Purpose and scope
These terms govern access to and use of GetCalls, a SaaS sales-prospecting assistant published by SAP Angel SA (Switzerland). Any subscription implies unreserved acceptance of these terms.
2. Account and eligibility
The service is primarily intended for professionals. The customer warrants the accuracy of the information provided and is responsible for keeping credentials confidential and for all activity carried out from their account.
3. Description of the service
- Analysis of a website, catalogue or description to infer the offer and the ideal customer profile
- Continuous prospect sourcing and scoring
- Preparation of approaches and follow-ups submitted for your approval
- Consolidation of conversations and retention of commercial context
The service is provided as is and evolves continuously. Volumes and rates mentioned in marketing communications are indicative and not guaranteed.
4. Free trial
A free trial may be offered, limited in duration and volume. At the end of the trial, a paid subscription starts only after the customer's explicit confirmation.
5. Prices and payment
- Prices are displayed in Swiss francs (CHF) and euros (EUR), excluding tax.
- Swiss VAT applies to Swiss customers. For EU business customers, the reverse charge applies upon presentation of a valid VAT number; otherwise the consumer's country VAT is charged.
- Billing is monthly or annual, charged in advance through our payment provider. Late payment may lead to suspension of access after a reminder.
6. Term and cancellation
The subscription runs for the chosen period and renews automatically. It can be cancelled at any time from the account, effective at the end of the current period, free of charge. SAP Angel SA may suspend or terminate an account in the event of a serious breach of these terms.
7. Customer obligations and acceptable use
- Comply with the terms of use of the third-party platforms involved, in particular LinkedIn.
- Only prospect in compliance with the GDPR, the Swiss FADP and applicable anti-spam rules (legitimate interest, information, objection).
- Do not send unlawful, misleading, harassing or discriminatory content.
- Review message content before sending: the customer remains the sender and is responsible for the communications sent.
Built-in safety caps (invitations, messages, profile views) cannot be changed and exist to protect the customer's account.
8. AI-generated content
Suggested texts are generated automatically. They may contain inaccuracies and must be reviewed before sending. The customer retains ownership of their data and of the content they approve.
9. Availability and support
Availability target of 99.5% excluding scheduled maintenance. Email support on business days, with a target response time of one business day.
10. Warranties and liability
No commercial results are guaranteed. To the extent permitted by law, SAP Angel SA's liability is limited to direct damages and capped at the amounts paid by the customer during the twelve months preceding the triggering event. Mandatory consumer rights remain reserved.
11. Data protection
Processing activities are described in the privacy policy. Where SAP Angel SA acts as a processor within the meaning of Art. 28 GDPR, a data processing agreement is entered into with the customer.
12. Changes
Any material change is notified at least 30 days in advance. If the customer disagrees, they may cancel free of charge before it takes effect.
13. Governing law and disputes
Swiss law applies, with jurisdiction at the registered office of SAP Angel SA. EU consumers retain the benefit of the mandatory provisions of their country of residence and may use the European online dispute resolution platform.
